What changed

The Bundesnetzagentur adopted the final MiSpeL (Marktintegration von Speichern und Ladepunkten) determination, ending the previous requirement to strictly separate green and grid electricity in storage systems and allowing bidirectional EV charging points to participate in the market on near-equal footing with batteries. The determination preserves EEG subsidy eligibility for temporarily stored renewable electricity and grants reduced levies/network fees for netted re-fed grid electricity, via two accounting methods: a precise 'Abgrenzungsoption' (delimitation option) open to all users, and a simplified 'Pauschaloption' (flat-rate option) for households with solar PV up to 30 kWp.

Why it matters

This determination activates millions of distributed batteries and EV charging points as market-responsive assets, enabling demand-side flexibility via dynamic tariffs and supply-side price-optimized direct marketing. It removes a major regulatory barrier that had excluded bidirectional charging points from market participation and clarifies how renewable subsidy entitlement and network fee relief are calculated for mixed (green/grid) storage flows, directly shaping prosumer economics and the pace of bidirectional EV integration in Germany.

MD analysis

MiSpeL represents a significant market-design intervention at the prosumer/storage interface, introducing a dual-track accounting framework (precise metering-based delimitation vs. flat-rate simplification) to resolve the long-standing green/grid electricity commingling problem in behind-the-meter storage. By extending EEG eligibility to temporarily stored renewable electricity and creating netting-based relief on levies and network fees, the rule changes the economics of self-consumption, arbitrage via dynamic tariffs, and direct marketing timing for storage operators. The explicit equal treatment of bidirectional charging points with stationary storage is a notable design choice that could accelerate V2G/V2H business models. However, the Pauschaloption's dependence on EU state-aid clearance, and the transition period running to September 2027, mean the practical, market-wide effect will be phased and partially contingent on a non-German regulatory process.

Rule / framework

BNetzA Festlegung (regulatory determination) under German energy law (EnWG/EEG framework); Pauschaloption additionally subject to European Commission state-aid approval
